General Terms and Conditions of Sale

1. Preamble
These terms and conditions govern the online sale of books, ebooks, audiobooks, and downloadable digital content (video courses and fitness programs) by Flow Motion SA, headquartered at via Monte Boglia 20, 6900 Lugano, Switzerland, via the website www.flow-motion.net. By placing an order, the user fully accepts these conditions.
2. Product Types
- Printed Books
- Ebooks (PDF and/or ePub formats)
- Audiobooks (MP3 format or streaming)
- Video Courses and Fitness Programs (downloadable MP4 or ZIP files)
Digital content is provided via a download link sent by email after payment.
3. Purchase Process
The user selects the products, completes the payment process, and receives confirmation via email. The contract is considered concluded upon receipt of the order confirmation.
4. Prices and Payments
All prices are expressed in Swiss Francs (CHF) and do not include VAT, according to Art. 10 of the Swiss Value Added Tax Act (VATA).
Accepted payment methods: credit/debit cards. Payment data is not stored by the seller but is processed through secure providers.
For orders from countries other than Switzerland, any duties, customs taxes, or import fees are the responsibility of the customer.
5. Product Delivery
- Printed books are shipped by post to the address provided. Shipments are processed within 1-3 working days. For deliveries abroad, any customs duties or import taxes are the responsibility of the recipient. Flow Motion SA is not responsible for delays due to customs procedures or events beyond its control.
- Digital content (ebooks, audiobooks, videos) is sent via a personal and temporary download link.
Digital files are hosted on Cloudflare R2 to ensure speed and security. Each download link is valid for a limited period (usually 7 days) and for a maximum number of downloads (usually 3).
6. Right of Withdrawal
There is no right of withdrawal for digital content, in accordance with Art. 40c of the Swiss Data Protection Act (nLPD) and Art. 16 of Directive 2011/83/EU. The immediate download constitutes an explicit waiver of the right of withdrawal. For printed books, returns or replacements are not accepted, except for printing defects. For defective printed books or those damaged during shipping, Flow Motion SA will replace them or provide a refund upon notification within 14 days of delivery.
7. Warranty and Support
In case of a damaged or non-functional file, the customer has the right to a free restoration of the content within 7 days of reporting. For support: info@flow-motion.net
8. Intellectual Property and License of Use
All content (texts, images, videos, audio) is the property of Flow Motion SA. The purchase of a video or ebook grants a personal, non-transferable license for exclusively private use. Any copying, distribution, or use in public contexts without written authorization is prohibited.
9. Liability Limitations
- temporary interruptions of digital services due to technical or network reasons;
- incompatibility of the user's device with the provided files;
- improper or non-compliant use of the purchased materials.
- Flow Motion SA shall not be liable for indirect or consequential damages arising from the use of the purchased products, except in cases of intent or gross negligence.
10. Competent Court
The contract is governed by Swiss law. The reference language for the interpretation of the contract is Italian. Exclusive place of jurisdiction: Lugano (Switzerland). Nothing in these terms limits the rights of EU consumers to bring proceedings in their country of residence, as provided by EU consumer law.
11. Delivery Times and Shipping Methods
Flow Motion SA ships all products from Switzerland within 1–3 working days of receiving payment. Deliveries within Switzerland are made via Registered Mail (usually 1–2 working days). Shipments to Europe and the rest of the world take on average 5–15 working days, depending on the destination country and customs clearance times.
Shipping Costs
- Switzerland: CHF 7.50 (Registered Mail)
- Europe: CHF 12.00 (Economy Mail)
- Rest of the world: CHF 18.00
Costs are automatically calculated in the shopping cart based on the destination. Any duties or import taxes are the responsibility of the recipient. Flow Motion SA is not responsible for delays due to customs, carriers, or force majeure.
